Terms & Conditions

Acceptance of Policies and Registration Conditions

This document constitutes the official Divity Group Inc.’s (“We”, “Us” or “Divity Group,” “AHF,” “Accelerate Her Future”) Accelerate Her Future Virtual Summit 2023 (“Virtual Summit”“Summit”“Event”) Terms and Conditions (“Terms & Conditions”). Prior to your registration, you must acknowledge and accept the Terms & Conditions contained herein. Should you not accept the Terms and Conditions, you should not register. Submission of a registration is regarded as affirmation of your acceptance of the 2023 Summit Terms & Conditions.

Participant Requirements

Access

Your registration entitles you access to the Summit for which you have registered. Any and all other costs associated with your attendance shall be borne solely by you, and We shall have no liability for such costs. 

Use of Likeness

By participating in the Summit you acknowledge and agree to grant us the right at the Virtual Summit to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to us includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media. 

Virtual Summit Content

You acknowledge and agree that Divity/AHF, in its sole discretion, reserves the right to change any and all aspects of the Virtual Summit, including but not limited to, the virtual Summit name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. 

Prohibited Conduct

Limitations on Use

By registering for a Virtual Summit pass you agree not to sell, trade, transfer, or share your complimentary access link and/or code, unless such transfer is granted by the Organizer. By registering for a paid Virtual Summit Pass, you agree not to share, sell or trade your access. If we determine that you have violated this policy, we may cancel your access, retain any payments made by you, report you to law enforcement authorities, and ban you from future Events and Programs. 

The Organizer name, trademarks, logo, and all related names, logos, product and service names, designs, images, and slogans are trademarks of the Divity Group or its affiliates or licensors. You must not use such marks without the prior written permission of the Organizer. Other names, logos, product and service names, designs, images, and slogans mentioned, or which appear in the Summit are the trademarks of their respective owners. Use of any such property, except as expressly authorized, shall constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject the infringer to legal action.

Any request for written permission to use our content, or any other intellectual property or property belonging to us, should be made before you wish to use the content by sending an e-mail to [email protected]

Disruptive Conduct.

You acknowledge and agree that we reserve the right to remove you from the Virtual Summit if we, in our sole discretion, determine that your participation or behavior creates a disruption or hinder the Virtual Summit or the enjoyment of the Virtual Summit content by other attendees. We are committed to providing a safe, productive, and welcoming environment to all participants, including staff and vendors, at the 2023  Virtual Summit. We have no tolerance for discrimination, harassment, or bullying in any form at our events. Participants are expected to adhere to these principles and respect the rights of others. We prohibit discrimination, harassment, and bullying against any person for any reason—for example, because of age, ancestry, disability, national origin, race, religion, gender, sexual orientation, gender identity, appearance, political affiliation, marital status, veteran status, or any other characteristic protected by law. Participants should report any behavior inconsistent with these principles to Summit staff.

Recording, Live Streaming, and Videotaping

Participants may not record or broadcast audio or video of sessions at the Virtual Summit. 

Unethical/Non-Compliant Business Practices

The Organizer reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices. 

Fees and Registration

Payment and Terms – Participants will pay a fee for the General Pass, Solidarity Pass, or Collective Pass to the Summit. The amount and payment terms are stated on the registration form. The Virtual Summit fee must be paid in full at the point of registration and prior to the Virtual Summit.

No Refund and Cancelation – All Summit passes (including General Pass,  Solidarity Pass, and Collective Pass) cannot be refunded. All sales are final, and the Organizer does not offer any money-back guarantees. You recognize and agree that you shall not be entitled to a refund for any purchase under any circumstances.

By purchasing a pass, you are securing your attendance at the Virtual Summit. All Summit passes are not transferable. 

Your ticket is a revocable license granted by Divity Group, which may be withdrawn, and admission refused at any time upon a refund of the printed registration price. Divity Group reserves the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket broker. Divity Group will not be responsible for any tickets that are lost or stolen.

Taxes

The registration fees are subject to HST which will be charged to you in addition to the fees. 

No Guarantee of Results

We do not warrant or guarantee that participation in the Summit or associated programs will match you with a prospective employer and/or lead to an interview or job opportunity with employers who participate in the Summit. 

Force Majeure

If Divity Group/AHF is prevented from carrying out its obligations as it pertains to the Virtual Summit you registered for as a result of any cause beyond its control, or such Virtual Event cannot be Virtually conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”) Divity Group/AHF shall have the right to immediately terminate the affected Virtual Summit without liability and shall be relieved of its obligations to Registrant. If the affected Virtual Summit is terminated due to a Force Majeure occurrence before the first day of the Virtual Summit, then your registration fee will be refunded.

For the purposes of clarity, Divity Group is not responsible for any loss or damage as a result of a substitution, alteration, cancellation or postponement of the Summit, or an event within the Summit shall assume no liability whatsoever in the circumstances described as Force Majeure. 

Please note that while speakers and topics are confirmed at the time of publishing, circumstances beyond the control of the organizers may necessitate substitutions, alterations or cancellations of the speakers and/or topics. As such, Divity Group reserves the right to alter or modify the advertised speakers and/or topics if necessary without any liability to you whatsoever. 

Registration Confirmation

Once you have completed your registration, you will receive your registration confirmation by email. Please ensure that your valid email is entered correctly on the registration form. Be sure to check your junk or spam folder in your email inbox too in case any of your Virtual Summit email(s) are caught by spam filters. 

You will receive essential information for registered attendees electronically at the email address and mailing address that are provided on your registration form. 

In addition, you will also be added to the Virtual Summit participant list for notifications of future programs and events. 

If you would like to opt-out of any of these benefits, a link is provided in each email to provide the ability to opt-out.

Personal Information

By registering for the Accelerate Her Future summit, you expressly consents to Divity Group, its agents, volunteers and/or representatives, storing, sharing and using the personal information submitted with his/her/their entry only for the purpose of administering the 2023 Virtual Summit and in accordance with Divity Group’s privacy policy www.accelerateherfuture.com.

The security of your personal information is very important to the Organizer. Divity Group uses physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although Divity Group does its best to protect your personal information, we cannot guarantee the security of your personal information. Any transmission of personal information is at your own risk. The Organizer is not responsible for circumvention of any privacy settings.

No Reliance

The information provided at the Virtual Summit is for general information purposes only. It is not intended to amount to advice on which you should rely. You must obtain more specific or professional advice before taking, or refraining from, any action or inaction on the basis of the content on our site.

Privacy Policy

By agreeing to the Terms & Conditions, you are also agreeing to the terms of the platform privacy policy available at privacy policy (the “privacy policy“). The privacy policy is incorporated into and deemed a part of this Terms & Conditions. The same rules that apply regarding changes and revisions of these Terms & Conditions also apply to changes and revisions of the privacy policy.

By accepting the terms of these Terms & Conditions, you hereby give your consent for Divity Group (and any potential subsidiaries) to collect, process and use your personal data for the purposes of processing the purchase of your ticket and for any other use to which you have consented, including the use of contact information for which you have provided your explicit prior consent or implicit consent by virtue of the transaction. 

This information will be used to aggregate data and trends gathered from the registration form and event feedback survey administered on an anonymous basis to enhance future summits, for inclusion in Accelerate Her Future impact and research reports and website or otherwise shared with funders or partners.

Independent Parties

The Virtual Summit participants acknowledge that they are acting independently from Divity Group/AHF and that they are solely responsible for its actions or inactions, and that nothing in these Terms & Conditions will be construed to create a partnership, agency, or employment relationship between Divity Group and the participants or its representatives.

Limitation of Liability

You agree, confirm, and acknowledge that we shall not be liable to you or to any third party for any indirect, incidental, consequential, special, punitive or exemplary damages.

We explicitly disclaim any liability with respect to any claim, suit or action made by a participant. You agree, confirm and acknowledge to indemnify, defend and hold us harmless with respect to any such claim

Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Divity Group, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, volunteers, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable lawyers’ fees) arising out of or relating to your breach of these Terms & Conditions.

If the applicable law does not allow the limitation of liability as set forth above (“Limitation of Liability”), the limitation will be deemed modified solely to the extent necessary to comply with applicable law.

This section shall survive the termination or expiration of these Terms & Conditions.

Intellectual Property

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within the website shall remain at all times owned by Divity Group. You are permitted to use this material only as expressly authorized by Divity Group.

Divity Group reserves all rights not expressly granted in and to the AHF website and in relation to the content on the AHF website.

Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and the laws of Canada applicable therein and treated in all respects as an Ontario contract. The Parties hereby irrevocably and unconditionally agree to the exclusive jurisdiction of the courts of the Province of Ontario and all courts competent to hear appeals.

International Users

The Virtual Summit is controlled, operated and administered by the Organizer from our offices within Canada. If you access the Virtual Summit from a location outside Canada, you are responsible for compliance with all local laws. 

Waiver

No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms and Conditions operates, or may be construed, as a waiver thereof. No single or partial exercise of any right, remedy, power, or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.

Severability

If any term or provision of these Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.

Entire Agreement

The Terms and Conditions and our Privacy Policy constitute the sole and entire agreement between you and Divity Group regarding the Virtual Summit and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding such subject matter.
